In this era of Computer and Internet Technology, protection to computer software are inevitable – Source code is the basis of computer software – There is no exclusive law for computer source code – Traditional crimes are punished under Indian Penal Code – But Indian Penal Code now become insufficient to deal with computer crimes and particularly to deal with offences related to computer source code. Source is written by using any of the computer languages – Computer languages are human-readable but understandable only to the persons skilled in the art – They are converted into machine language by the compilers – In between they are susceptible to misuse. Sec.65 of Information Technology Act specifically deals with the offence related computer source code – The offences are linked with Sec.24 of Indian Penal Code also for determining the legal elements to prove the offense – The offences related to computer source code comprise of techno-legal aspects. Information Technology Act in India has relationship with other transnational and international law also – Convention on Cyber Crimes, U.S Code (1030), U.K Computer Misuse Act are the related laws – But still IT Act is not an exclusive Act to deal with computer source code – We have requirement to apply Cyber Forensic Jurisprudence in the cases related to computer source code.Code also for determining the legal elements to prove the offense – The offences related to computer source code comprise of techno-legal aspects.
