The Indian Trademark Act 1940,The Indian Trademark and Merchandise Marks Act 1958 and finally these laws were replaced by the Trademark Act of 1999 which is an act to amend and consolidate the laws relating to Trademark to provide for registration and better protection of trademarks for goods and services and to prevent its use by others. The Act grants exclusive rights to the registered proprietor over the registered trademarks. He can use it by himself and grant licenses to others as registered users. He can protect it from being infringed by others by initiating civil and criminal action against the infringers.
